- Why did the bar date reopen?
The Court issued an Opinion on March 9, 2023, stating that account holders only have claims against Celsius Network LLC under the Terms of Use, and the Debtors amended the Schedules to reflect this Opinion. As a result, the bar date was extended to April 28, 2023.
2. When is the new Bar Date?
On April 18, 2023, the Court approved the UCC’s motion to file a class claim for non-contract claims on behalf of account holders. In the coming weeks, the UCC will be filing a proposed class claim and a motion to certify a class. The Bar Date is delayed until further notice pending an order of the Court regarding the UCC’s forthcoming class certification motion. 3. Why were the Schedules amended?
The Schedules were amended to reflect the Court’s ruling that only Celsius Network LLC is liable for contract claims under Celsius’ Terms of Use. The Court’s opinion may be found on Stretto at Docket No. 2205.
4. Is my previous claim still valid?
Yes, if you previously filed a Proof of Claim, it is still valid. You do not need to refile or amend your previous claim at this time.
5. Can I still file a non-contract claim against other Celsius entities?
Yes, account holders can file claims against Celsius Network Ltd. and all other Debtors until further notice.
6. What do I need to do?
If you previously filed a Proof of Claim and agree with the amended Schedules, no further action is required. If you disagree with the amended Schedules or if you have not previously filed a Proof of Claim and wish to do so, you can find the claim form on Stretto. If you would like to withdraw a filed proof of claim, please contact CelsiusClaimsProcedures@kirkland.com.
